New Mexico Child Safety Seat and Seat Belt Laws

New Mexico state law requires all children under the age of 18 to be properly restrained in a car seat, booster seat or seat belt. Properly restrained is defined as: (i) children under the age of 1 must ride in rear-facing and federally approved car seats in the back seat, not in front of an airbag; (ii) children ages 6 and under and children who weigh less than 60 pounds regardless of their age must be properly secured in a federally approved car seat or booster seat; and (iii) children ages 7 - 12 must be properly secured in a seat belt or federally approved booster seat that fits their height and weight.  When children are wearing a seat belt, the lap belt should sit low across the hips and not on the abdomen, and the shoulder portion of the seat belt should cross the chest and not the head or neck.
